Residential Snow Removal Service Agreement

1. The Parties

This Snow Removal Service Agreement (the \"Agreement\") is made and entered into as of the date of quote approval (the “Effective Date”).

BETWEEN:

Buzz Lawn Care (the “Contractor”)

AND:

The “Client” - approver of the quote

2. Term of Agreement

This Agreement shall be effective for the period commencing on November 1, 2025, and terminating on March 31, 2026 OR another date agreed upon by both parties (the \"Term\").

3. Scope of Services

The Contractor agrees to provide snow removal services for the designated areas at the Service Address (collectively, the \"Service Areas\").

Site map included in this quote, including areas to be serviced.

Snow will be cleared and piled in a safe and suitable location on the Client’s property at the Contractor's discretion. This service does not include hauling snow off-site.

The Contractor does not claim responsibility for clearing windrows on the property.

4. Service Triggers and Timing

Snowfall Event Definition: A \"Snowfall Event\" is defined as an accumulation of 1.0 cm or more of snow. Snowfall accumulation will be determined by data from the nearest Environment Canada weather station.

Service Guarantee: The Contractor guarantees that service will be completed within 24 hours of the end of a Snowfall Event.

*Exception: December 25, Christmas Day. Service will be provided December 26.

Multi-Day Snowfall: In the event of a continuous Snowfall Event lasting longer than 24 hours, the Contractor will perform one service visit per 24-hour period to maintain accessibility.

5. Compensation and Payment Terms

Cost of Service: The Client agrees to pay the Contractor a flat monthly rate listed in the quote plus GST for the services outlined in this Agreement.

Payment Schedule: Payment is due on the first (1st) day of each month for the upcoming month of service. Invoices will be sent electronically to the Client’s email address on file 7 days before the start of the month.

Payment can be made via Electronic Transfer, Credit Card, or Mailed Cheque. Credit Card payments subject to a 3% service charge. Credit Card information can be held on file for automatic payments.

Late Payments: Payments not received within 7 days of the due date will be subject to a late fee of 2% per month on the outstanding balance. Services will be suspended if an account is more than 7 days overdue if arrangements are not previously made.

6. Client Responsibilities

Access and Obstructions: The Client shall ensure that the Service Areas are free of all vehicles, equipment, toys, extension cords, decorations, and any other obstructions prior to the Contractor's arrival. The Contractor is not required to service areas that are blocked, and no refund will be issued for such areas. A return visit to clear an obstructed area may be subject to an additional fee.

Hazards: The Client must notify the Contractor of any objects or potential hazards that may be concealed by snow, such as curbs, pipes, or decorative landscaping items.

7. Liability and Property Damage

Damage: The Contractor is not responsible for any damage to objects, landscaping, or pavement that are not clearly visible or properly marked, or for pre-existing damage to the property. The Contractor is only responsible for property damage caused directly by the negligence of its employees or equipment. Any damage must be reported to the Contractor within 24 hours of the service visit.

Ice Conditions and Safety: The services provided under this Agreement are for snow removal, not ice management. The Contractor is not responsible for monitoring or treating ice accumulation that may form between service visits due to melting, refreezing, or freezing rain. The Client acknowledges that they retain responsibility for the overall safety of their property, and the Contractor shall not be held liable for any slip-and-fall incidents or injuries that may occur on the property.

8. Insurance

The Contractor agrees to maintain, at its own expense, Comprehensive General Liability insurance with a limit of not less than $2,000,000 for the duration of this Agreement.

9. Termination

Either party may terminate this Agreement with 7 days' written notice to the other party. If the Client terminates the agreement mid-season, any seasonal discounts may be forfeited, and services rendered will be retroactively billed at the standard month-to-month rate.

10. General Provisions

Independent Contractor: It is understood that the Contractor is an independent contractor and not an employee of the Client.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta.

11. Agreement

By signing or approving the sent quote, both parties acknowledge that they have read, understood, and agree to the terms and conditions set forth in this Agreement.
